Terms of Service

These Terms of Service ("Terms") govern access to and use of Atlas Receptionist and other AI Employee services provided by Zaya LLC ("Zaya," "we," "us," or "our") (the "Services"). By accessing or using the Services, you agree to these Terms.

Acceptance and Service Description

Atlas Receptionist is an AI-powered receptionist service that answers calls and messages, communicates with callers and customers, schedules and manages appointments, and relays information on behalf of the businesses that engage Zaya. By using the Services, whether as a Zaya customer or as an individual interacting with Atlas Receptionist, you agree to be bound by these Terms.

AI-Assistant Limitations

Atlas Receptionist is an automated assistant. Responses are generated using artificial intelligence and automated systems, and interactions may be recorded or logged. While we design the Services to be accurate and helpful, automated responses may occasionally be incomplete, delayed, or incorrect. The Services are not a substitute for emergency services — if you have an emergency, contact local emergency services directly.

Permitted Use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You may not use the Services to transmit unlawful, abusive, or fraudulent content, to interfere with or disrupt the Services, or to attempt to gain unauthorized access to our systems.

Customer Responsibilities

Business customers are responsible for providing accurate information for Atlas Receptionist to relay, for obtaining any consents required from their own customers or callers (including consent to receive SMS communications, where applicable), and for their own compliance with laws applicable to their business.

Third-Party Services

The Services rely on third-party infrastructure, including telephony, messaging, cloud infrastructure, and AI service providers, to deliver calls and messages. We are not responsible for outages, delays, or failures caused by third-party providers or carrier networks that are outside our reasonable control.

Availability and Service Changes

We aim to keep the Services available and reliable, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Services at any time, including for maintenance, security, or product changes.

Intellectual Property

The Services, including the Atlas platform, software, branding, and related materials, are owned by Zaya or its licensors and are protected by intellectual property laws. Nothing in these Terms grants you any ownership rights in the Services.

Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ZAYA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

Termination

We may suspend or terminate access to the Services at any time if we reasonably believe these Terms have been violated, or for operational or legal reasons. Customers may stop using the Services at any time by ceasing use and, where applicable, canceling their account.

Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles.

Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the effective date above. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

SMS Terms

This section governs SMS text messaging sent or received in connection with Atlas Receptionist.

  • The program sends low-volume service-request acknowledgments, appointment confirmations and reminders, scheduling updates, customer-care replies, and requested follow-up information.
  • Messages are sent only after you provide explicit consent to receive them.
  • Consent to receive messages is not a condition of purchasing any goods or services.
  • Message frequency varies depending on your service requests and appointments.
  • Message and data rates may apply.
  • Reply STOP at any time to opt out of further messages.
  • Reply HELP for assistance, or email [email protected].
  • Carriers are not liable for delayed or undelivered messages.
